Clean ownership paper is essential for buying property in Croatia

What is clean ownership ?

Clean ownership is a must for you to purchase property or land here in Croatia and is probable one of the main issues. The clean ownership must be established at the earliest time and thus reduce wasted expense and time. Proof of ownership can be found at the land registry office

 It has only been in the last 10 or 12 years that a Real Estate market has existed. Before that the majority of properties were passed down from one generation to another often cousins, brothers, sisters, aunts and uncles  owned a part share of a property. Also at that time the land registry office didn`t keep such good  and accurate records as it does now. Tracing the owners and co- owners of these properties is both costly and timely with many of the relations living in other countries. As you travel around Croatia you will often see deserted Villas and houses all in need of renovation but unfortunately the lack of clean ownership prevents these gems from being bought or sold.

Your lawyer will check all documentation and ensure that there are no "debts" or burdens on the property. All listings in the  land registry must be true and clear. There must be clearly defined  ownership , if there are several owners then one party has to be elected  and have full power to sign and act for all other owners. The documentation must not be older that 3 months and must be the original as provided by the land registry office.
